These Terms and Conditions set out the basis on which we provide rubbish removal and waste collection services in Colliers Wood and surrounding areas. By booking a collection, you agree to be bound by these terms. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions:

Client means the person or business making the booking for rubbish removal or waste collection services.

Company, we, us, or our means the service provider supplying the waste collection and rubbish removal services.

Services means any rubbish removal, waste collection, clearance, loading, transportation, or related services provided by the Company.

Site means the property, premises, or location at which the Services are to be carried out.

Waste means items, materials, or rubbish presented for removal, excluding any prohibited or hazardous materials as defined in these terms or under applicable law.

2. Scope of Services

2.1 The Company provides rubbish removal and waste collection services for domestic and commercial Clients, including but not limited to the removal of household rubbish, bulky items, garden waste, and general non-hazardous waste.

2.2 The exact scope of the Services, including the volume and type of waste to be collected, the date and time of collection, and any access requirements, will be confirmed at the time of booking.

2.3 The Company reserves the right to refuse to collect any items that are prohibited, unsafe to handle, or not as described at the time of booking, including but not limited to hazardous waste, chemicals, asbestos, medical waste, or any materials prohibited under UK waste regulations.

3. Booking Process

3.1 Bookings may be made by telephone, email, or through any other booking method the Company makes available.

3.2 When making a booking, the Client must provide accurate information about the type and approximate volume of waste, access to the Site, parking conditions, and any other relevant details that may affect the provision of the Services.

3.3 The Company may provide an initial estimate based on the information provided by the Client. This estimate is not a fixed quotation and may be subject to change following an inspection of the waste and Site on arrival.

3.4 A booking is only confirmed when the Company has accepted the booking request, provided a date and estimated time for the collection, and, where applicable, received any required deposit or pre-payment.

3.5 The Client must ensure that an authorised person is present at the Site at the agreed time of collection to grant access, confirm the waste to be removed, and approve any changes to the price if applicable.

4. Pricing and Quotations

4.1 Prices are generally based on a combination of the volume of waste collected, the weight of certain materials, the time required to complete the work, and any additional services required such as dismantling, packing, or special handling.

4.2 Any quotation provided prior to arrival at the Site is an estimate only and may be adjusted once the team has inspected the waste in person. If the actual volume, weight, or nature of the waste differs from the Client s description, the price may increase or decrease accordingly.

4.3 If, upon inspection, the revised price is not acceptable to the Client, the Client may decline to proceed with the Services. In this case, the Company reserves the right to charge a call-out or attendance fee to cover reasonable costs, which will be communicated to the Client in advance where possible.

4.4 All prices are quoted in pounds sterling and may be subject to applicable VAT or other taxes, which will be stated where relevant.

5. Payments

5.1 Payment terms will be confirmed at the time of booking. The Company may require full payment in advance, a deposit, or payment on completion of the Services, depending on the nature and size of the job.

5.2 Payment may be made by cash, bank transfer, debit card, credit card, or any other method accepted by the Company at the time of booking.

5.3 Where payment is due on completion, the Client must make payment immediately once the Services have been carried out and before the team leaves the Site, unless alternative arrangements have been agreed in writing.

5.4 For commercial Clients with agreed credit terms, invoices are payable within the timeframe stated on the invoice. If no timeframe is stated, invoices are payable within 14 days of the invoice date.

5.5 The Company reserves the right to charge interest on late payments at the statutory rate applicable in the UK, as well as reasonable costs incurred in recovering overdue sums.

6. Cancellations and Amendments

6.1 The Client may cancel or amend a booking by contacting the Company as soon as possible and no later than 24 hours before the scheduled collection time, unless a different period is stated at the time of booking.

6.2 If the Client cancels a booking with less than 24 hours notice, or fails to provide access to the Site at the agreed time, the Company reserves the right to charge a cancellation fee or call-out fee to cover reasonable costs, including staff and vehicle allocation.

6.3 If the Company needs to cancel or reschedule a booking due to reasons beyond its control, such as vehicle breakdown, staff illness, severe weather, or other operational issues, it will notify the Client as soon as reasonably possible and offer an alternative collection time. The Company will not be liable for any indirect or consequential loss arising from such cancellation or rescheduling.

6.4 If the Client requests significant changes to the scope of work, such as a substantial increase in waste volume or additional services, the Company may treat this as a new booking and adjust pricing and timing accordingly.

7. Client Responsibilities and Site Access

7.1 The Client must ensure safe and reasonable access to the Site for the Company s vehicles and staff, including adequate parking, clear walkways, and safe access to the waste to be removed.

7.2 Any parking restrictions, permits, or charges applicable near the Site are the responsibility of the Client. If parking fees or penalties are incurred as a result of insufficient information or failure to arrange appropriate parking, the Client may be required to reimburse these costs.

7.3 The Client must ensure that the waste presented for collection is safe to handle and free from sharps, hazardous materials, or concealed dangerous objects. The Company reserves the right to refuse to handle any waste it reasonably considers unsafe.

7.4 The Client is responsible for obtaining any necessary permissions, consents, or approvals from landlords, neighbours, building managers, or local authorities to allow the Services to be carried out.

8. Waste Types and Regulations

8.1 The Company operates in compliance with relevant UK waste management legislation and regulations. All waste collected will be transported and disposed of at authorised facilities in accordance with applicable laws.

8.2 The Company cannot accept certain hazardous or prohibited waste types, including but not limited to asbestos, clinical or medical waste, biological waste, certain chemicals, solvents, oils, gas bottles, explosives, or any other substances classified as hazardous under UK regulations.

8.3 If hazardous or prohibited waste is discovered among the materials presented for removal, the Company may refuse to collect some or all of the waste and may charge a reasonable fee for attendance and any work already carried out.

8.4 The Client is responsible for ensuring that waste declared as general rubbish does not contain hazardous items. If the Company incurs additional costs due to misdescription of waste, the Client may be liable for those costs.

8.5 The Company may, where required, provide a waste transfer note or other documentation as evidence of lawful transfer of waste. The Client agrees to provide any information reasonably requested to complete such documentation.

9. Liability and Limitations

9.1 The Company will exercise reasonable care and skill when providing the Services. However, the Company will not be liable for any pre-existing damage at the Site or to any items not intended for removal.

9.2 The Client must remove or secure any valuable, fragile, or sensitive items that are not to be taken away, and clearly indicate any items which must not be removed.

9.3 The Company s liability for loss or damage to property arising from its negligence shall, to the extent permitted by law, be limited to the reasonable cost of repair or replacement, and in any event limited to the total price paid or payable for the relevant Services.

9.4 The Company will not be liable for any indirect, consequential, or economic losses, including loss of profit, loss of business, loss of opportunity, or any loss arising from delay, except where such limitation is prohibited by law.

9.5 Nothing in these Terms and Conditions limits or excludes the Company s liability for death or personal injury caused by negligence, fraud, or any other liability that cannot legally be limited or excluded under UK law.

10. Insurance

10.1 The Company maintains appropriate insurance cover for its operations in accordance with industry standards, including public liability insurance.

10.2 Details of insurance cover can be provided to the Client on request. The existence of such insurance does not extend or increase the Company s liability beyond the limits set out in these Terms and Conditions.

11. Delays and Events Beyond Our Control

11.1 The Company will make reasonable efforts to provide the Services at the agreed time, but any time stated for arrival or completion is an estimate only and is not guaranteed.

11.2 The Company will not be liable for any delay or failure to perform the Services due to events beyond its reasonable control, including but not limited to traffic conditions, accidents, severe weather, vehicle breakdown, industrial disputes, or restrictions imposed by authorities.

11.3 If a significant delay occurs, the Company will inform the Client as soon as reasonably possible and arrange a revised time for completion of the Services where appropriate.

12. Complaints

12.1 If the Client is dissatisfied with any aspect of the Services, the Client should notify the Company as soon as possible, preferably within 48 hours of the work being completed.

12.2 The Company will investigate any complaint and, where appropriate, may offer a remedy such as additional work, a partial refund, or another form of resolution, at its discretion and in line with its legal obligations.

13. Data Protection and Privacy

13.1 The Company will collect and use personal information provided by the Client for the purposes of administering bookings, providing the Services, processing payments, and managing customer relationships.

13.2 Personal information will be handled in accordance with applicable data protection laws in the UK. The Company will take reasonable measures to keep personal data secure and will not share it with third parties except where necessary to provide the Services, comply with legal obligations, or with the Client s consent.

14. Amendments to These Terms

14.1 The Company may update or amend these Terms and Conditions from time to time. Any changes will apply to new bookings made after the updated terms are published or communicated.

14.2 The Terms and Conditions in force at the time of the Client s booking will apply to that booking, unless a change is required by law or regulatory authority, in which case it may apply to existing bookings as well.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

15.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided.

16. General Provisions

16.1 If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court, that provision shall be deemed deleted and the remaining provisions shall continue in full force and effect.

16.2 No failure or delay by the Company in exercising any right or remedy under these Terms and Conditions shall be construed as a waiver of that right or remedy.

16.3 These Terms and Conditions constitute the entire agreement between the Client and the Company in relation to the Services and supersede any prior discussions, correspondence, or understandings.

16.4 The Client may not assign or transfer any of their rights or obligations under these Terms and Conditions without the prior written consent of the Company. The Company may assign or subcontract its rights and obligations where necessary to provide the Services, provided that such assignment does not materially reduce the level of service to the Client.

By making a booking for rubbish removal or waste collection services, the Client confirms that they have read, understood, and agree to be bound by these Terms and Conditions.
